CONVENTION
On legal assistance and legal relations
In Civil, Family and Criminal Matters
(Chisinau, October 7, 2002)
States members of the Commonwealth of Independent States Parties to the present Convention, hereinafter referred to as the Contracting Parties,
based on the desire to ensure that the citizens of each of the Contracting Parties and other persons residing in its territory, legal protection for their personal, economic and moral rights in the territories of all the Contracting Parties
Attaching great importance to the development of cooperation in the field of judicial institutions of legal assistance in civil, family and criminal cases,
Have agreed as follows:
SECTION I. GENERAL PROVISIONS
Part I
LEGAL PROTECTION
Article 1
The provision of legal aid
1. The nationals of each of the Contracting Parties, as well as other persons residing in its territory enjoy in the territories of all other contracting parties the same legal protection of their personal property and non-property rights, as well as their own nationals of that Contracting Party.
2. The nationals of each of the Contracting Parties, as well as other persons residing in its territory, have the right to free and unimpeded access to the courts, prosecutors, police, security agencies and other institutions of the other Contracting Parties, the responsibility for the civil, family and criminal cases (hereinafter referred to as the institutions of justice) may serve them to file appeals sue and take other remedial action under the same conditions as the nationals of that Contracting Party.
3. The term "civil cases" as used in this Convention also includes cases relating to resolve economic disputes.
4. The provisions of this Convention shall also apply to legal persons.
Article 2
Exemption from payment of fees and reimbursement of expenses
1. The nationals of each of the Contracting Parties and other persons residing in its territory, and shall be exempt from the payment of compensation for legal and notary fees and costs, as well as enjoy free legal aid in the territories of other contracting parties on the same terms and conditions as its own nationals.
2. Benefits provided for in paragraph 1 of this Article shall apply to all proceedings carried out in civil, family and criminal matters, including the enforcement of a decision or judgment.
Article 3
Representation of the document on the family
and financial status
1. Benefits provided for in Article 2 of this Convention, provided on the basis of an instrument of family and property status of a person, the exciting motion. This document is issued by the competent authority of a Contracting Party in the territory of which is domiciled or resident applicant.
2. If the applicant is not in the territory of the Contracting Party of residence or abode, it is enough to present a document issued by the appropriate diplomatic or consular mission of a Contracting Party to which he belongs.
3. Establishment of adjudicating on the application for grant of benefits may require of the authority issuing the document, additional information or clarifications.
